These Terms of Use constitute a legally binding agreement between you ("Student," "User," or "you")
and Axilingua ("we," "us," or "our"), governing your access to and use of the Axilingua TOEFL iBT
Training Platform at toefltest.axilingua.com.
By creating an account, making a purchase, or using any part of the platform, you agree
to these Terms in full. If you do not agree, do not access or use the platform.
01 The Service
Axilingua provides an online TOEFL iBT preparation platform that includes AI-powered practice
tools, exercises, feedback systems, progress tracking, and course content. The platform is
designed to help students prepare for the TOEFL iBT exam administered by ETS.
Independent platform: Axilingua is an independent preparation service and is
not affiliated with, endorsed by, or officially connected to ETS (Educational Testing Service)
or the TOEFL program. "TOEFL" and "TOEFL iBT" are registered trademarks of ETS.
We reserve the right to modify, update, or discontinue any feature or content on the platform
at any time, with or without prior notice.
02 Eligibility
To use this platform, you must:
- Be at least 13 years of age. Users between 13 and 18 must have parental or guardian consent.
- Have the legal capacity to enter into a binding agreement under the laws of your country of residence.
- Not be previously suspended or removed from the platform for a violation of these Terms.
By using the platform, you represent and warrant that you meet all eligibility requirements
listed above.
03 Account Registration
Access to the platform requires creating a personal account. When registering, you agree to:
- Provide accurate, current, and complete information.
- Keep your password confidential and not share it with any third party.
- Notify us immediately if you suspect unauthorized access to your account.
- Take responsibility for all activity that occurs under your account.
Accounts are personal and non-transferable. You may not create accounts on behalf of others
without their explicit consent, or use another person's account.
One account per person: Creating multiple accounts to circumvent access
restrictions, usage limits, or subscription requirements is prohibited and may result in
immediate account termination.
04 Payments & Subscriptions
Access to premium content and practice tools requires the purchase of a subscription plan.
By completing a purchase, you agree to the following:
- Pricing: All prices are listed in U.S. dollars (USD) unless otherwise indicated. Applicable taxes may be added at checkout depending on your location.
- Payment processing: Payments are processed securely by Stripe. Axilingua does not store or have access to your credit or debit card information at any time.
- Billing: Subscription fees are charged at the time of purchase for the selected access period (monthly, quarterly, or as offered at the time of purchase).
- Renewals: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You will receive a reminder before renewal.
- Cancellation: You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You retain access until the period ends.
- Price changes: We reserve the right to change subscription pricing. You will be notified at least 14 days before any price change takes effect for your active subscription.
05 Refund Policy
We want you to be satisfied with your purchase. The following refund policy applies:
- 7-day refund window: If you are unsatisfied with your purchase, you may request a full refund within 7 days of your initial purchase, provided you have completed fewer than 10 practice exercises during that period.
- No refund after 7 days: Refund requests submitted after 7 days from the date of purchase will not be honored, except where required by applicable law.
- Renewals: Automatic renewal charges are non-refundable unless you did not receive notice of the upcoming renewal. In such cases, contact us within 5 days of the charge.
- Technical issues: If the platform is inaccessible due to a technical error on our side for an extended period (48+ hours), you may be eligible for a prorated credit or refund. Contact us to report the issue.
Consumer rights: Regardless of the policy above, applicable consumer protection
laws in your country of residence may grant you additional refund rights. These Terms do not
override rights you have under local law in Brazil, Mexico, Colombia, Peru, the European Union,
or any other jurisdiction.
To request a refund, contact us at the address in Section 15 with your order number and
reason for the request.
06 Acceptable Use
You agree to use the platform only for its intended purpose: personal TOEFL iBT exam preparation. The following are strictly prohibited:
- Sharing your account credentials with others or allowing third parties to access your account.
- Reproducing, distributing, reselling, or publishing any platform content — including exercises, feedback, audio, or course materials — without written permission from Axilingua.
- Using automated tools, bots, scrapers, or scripts to access, extract, or interact with the platform.
- Attempting to reverse-engineer, copy, or replicate the platform's tools, exercises, prompts, or evaluation logic.
- Submitting harmful, offensive, or unlawful content through practice response fields.
- Attempting to manipulate, circumvent, or exploit the AI evaluation system.
- Using the platform in a way that violates any applicable local, national, or international law.
Violation of any of these rules may result in immediate suspension or termination of your
account without refund.
07 Artificial Intelligence Disclosure
Several features of the Axilingua platform use Artificial Intelligence (AI) to generate
practice content and evaluate student responses.
AI is used for the following functions:
- Generating unique academic discussion prompts, reading passages, and writing scenarios.
- Evaluating written responses against official ETS scoring rubrics and returning scores and feedback.
- Evaluating spoken practice responses and returning pronunciation and fluency feedback.
- Generating text-to-speech audio for Speaking exercises.
By using these features, you acknowledge and agree that:
- AI scores are not official ETS scores. Scores generated by the platform are approximations for practice purposes only and do not represent, predict, or guarantee your performance on the actual TOEFL iBT exam.
- AI feedback may contain errors. While we continuously improve our evaluation system, AI-generated feedback is not infallible. Use it as a guide, not as a definitive assessment.
- Our scoring standard is intentionally strict. The platform applies a slightly higher standard than ETS by design, to help you exceed the real exam requirements. Your actual TOEFL score may be equal to or higher than your scores on this platform.
- Your responses are processed by AI. Text and spoken transcripts you submit are sent to our AI provider for evaluation. This data is handled in accordance with our Privacy Policy.
08 Intellectual Property
All content on the Axilingua platform — including but not limited to exercises, passages,
audio recordings, feedback systems, course materials, design elements, and software — is
the exclusive property of Axilingua or its licensors and is protected by applicable
intellectual property laws.
Your subscription grants you a limited, personal, non-exclusive, non-transferable license
to access and use the platform content for your individual TOEFL preparation. This license
does not permit you to:
- Copy, reproduce, or distribute platform content in any form.
- Use platform content for commercial purposes or to create competing products.
- Remove, alter, or obscure any copyright, trademark, or proprietary notices.
ETS Trademarks: "TOEFL," "TOEFL iBT," and related marks are registered
trademarks of ETS. Their use on this platform is for descriptive and educational reference
purposes only. Axilingua is not affiliated with or endorsed by ETS.
Any content you submit through practice response fields (written text, spoken audio) remains
yours. By submitting it, you grant Axilingua a limited license to process it through our AI
evaluation system for the purpose of generating your feedback and score.
09 Disclaimer of Warranties
The platform is provided on an "as is" and "as available" basis. To the fullest extent
permitted by applicable law, Axilingua makes no warranties — express, implied, or statutory —
regarding the platform, including but not limited to:
- Fitness for a particular purpose (including achieving a specific TOEFL score).
- Uninterrupted, error-free, or secure operation of the platform.
- Accuracy, completeness, or reliability of AI-generated content or scores.
- That use of the platform will result in improved exam performance.
We make every effort to keep the platform available and accurate, but we cannot guarantee
this at all times. Scheduled maintenance, technical issues, or third-party service disruptions
may cause temporary unavailability.
10 Limitation of Liability
To the maximum extent permitted by applicable law, Axilingua and its operators shall not be
liable for any indirect, incidental, special, consequential, or punitive damages arising from
your use of or inability to use the platform, including but not limited to:
- Loss of data or progress records.
- Failure to achieve a desired TOEFL score.
- Errors or inaccuracies in AI-generated feedback or scores.
- Unauthorized access to your account by third parties.
- Interruption or discontinuation of the service.
In all cases, Axilingua's total liability to you for any claim arising out of or relating to
these Terms or the platform shall not exceed the total amount you paid to Axilingua in the
12 months preceding the claim.
Consumer protection notice: Some jurisdictions do not allow the exclusion of
certain warranties or limitation of liability. If you are located in such a jurisdiction
(including but not limited to Brazil, Colombia, Mexico, or EU member states), some of the
limitations above may not apply to you, and you may have additional legal protections
under local consumer law.
11 Dispute Resolution & Arbitration
We encourage you to contact us first to resolve any issue or concern. Most disputes can be
resolved quickly through direct communication.
Informal resolution: Before initiating any formal proceeding, you agree to
contact us at the address in Section 15 and give us 30 days to attempt to resolve the dispute
informally.
Binding arbitration: If informal resolution fails, you and Axilingua agree
that any dispute, claim, or controversy arising out of or relating to these Terms or the
platform shall be resolved by binding individual arbitration, rather than in court. By
agreeing to arbitration, you and Axilingua each waive the right to a jury trial and the
right to participate in a class action lawsuit or class-wide arbitration.
No class actions: You may only bring claims against Axilingua in your
individual capacity. You may not bring a claim as a plaintiff or class member in any
class action, consolidated action, or representative proceeding.
Exception: Either party may seek injunctive or other equitable relief in a
court of competent jurisdiction to prevent actual or threatened infringement of intellectual
property rights.
Consumer rights: Nothing in this section limits any rights you may have
under the consumer protection laws of your country of residence, including mandatory local
dispute resolution mechanisms available in Brazil (PROCON), Mexico, Colombia, or other
applicable jurisdictions.
12 Termination & Suspension
By you: You may close your account at any time by contacting us. Upon
closure, your access to premium content will end at the conclusion of your current billing
period.
By Axilingua: We reserve the right to suspend or terminate your account
at any time, with or without notice, if we determine that you have violated these Terms.
Violations that may result in immediate termination include, but are not limited to:
- Sharing account access with unauthorized third parties.
- Attempting to scrape, copy, or reproduce platform content.
- Fraudulent use or chargebacks without legitimate basis.
- Any behavior that harms the platform, other users, or Axilingua.
Upon termination for cause, you forfeit any remaining subscription period and no refund
will be issued. We will retain your data as described in our
Privacy Policy.
13 Changes to These Terms
We may update these Terms of Use at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Send an email notification to your registered address at least 14 days before changes take effect, where required by law or where changes materially affect your rights.
Your continued use of the platform after the effective date of any updated Terms constitutes
your acceptance of the new Terms. If you do not agree with the changes, you must stop using
the platform before the effective date.
14 Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Because
Axilingua serves users in multiple countries, the following applies:
- These Terms do not override mandatory consumer protection laws applicable in your country of residence.
- Users in Brazil have rights under the LGPD and the Brazilian Consumer Defense Code (CDC — Lei 8.078/90).
- Users in the European Union have rights under GDPR and applicable EU consumer law.
- Users in Mexico, Colombia, and Peru have rights under their respective national consumer and data protection laws.
- Users in the United States have rights under applicable federal and state laws, including California's CCPA.
Where mandatory local law conflicts with any provision of these Terms, the applicable local
law shall prevail to the extent of the conflict.
